Bill Enables Lottery to Increase Return to Players

Lottery Bill Introduced Today

ALBUQUERQUE, New Mexico (January 22, 2018) -- Representative Smith introduced HB 147 today, which is estimated to provide an additional $25 million in scholarship funding for students over the next five years.

The Lottery transferred $37.8 million to the scholarship fund in fiscal year 2017, which equates to paying sixty percent (60%) of a student’s tuition bill.

A similar bill has been introduced in each of the prior three legislative sessions by Senator John Arthur Smith. It is very important the lottery continues to meet with and inform key constituents regarding legislation that impacts scholarship transfers.

The bill guarantees students a minimum of $38 million each year for the scholarship program which is a $200,000 increase over last year’s transfer. The bill includes a sunset provision that requires the lottery to return to the thirty percent (30%) mandate if scholarship proceeds fall below the $38 million floor.

By alleviating the mandate, the Lottery will be able to put more prizes in games, in turn increasing sales and thus increasing dollars raised for students.

The bill is a win for students and is like a bill passed in Oklahoma last June which repealed their mandated return. Oklahoma anticipates an additional $110 million in transfers over the next five years.

The mandate repeal in Oklahoma has been so successful that it is exceeding previous fiscal year estimates. So far, this fiscal year, they’ve seen a sixty percent (60%) increase in Scratcher sales and a forty percent (40%) increase in transfers.

Legislative Lottery Scholarships

All profits from the sale of New Mexico Lottery games fund an in-state college tuition assistance program.  Since 1996, the New Mexico Lottery has raised $755.2 million for education and more than 116,000 students have attended college on Legislative Lottery Scholarships.

Online Privacy: European Online Gambling Operators File Data Protection Complaint Against Unlawful Payment Blocking Scheme in Norway

BRUSSELS, Belgium (January 18, 2018) --The European Gaming and Betting Association (EGBA) has asked the Norwegian Data Protection Inspectorate (DPI) to urgently investigate a Norwegian payment blocking scheme for serious breaches of the privacy of Norwegian citizens when conducting online payments. The scheme established by the Norwegian Gaming Authority (NGA) is in contravention of Norwegian Data Protection laws and the European Convention on Human Rights according to the EGBA, representing Europe’s leading online gambling operators.

The Norwegian Payment Blocking Regulation exists since 2010 and essentially prohibits businesses from carrying out payments of bets and prizes in online gambling services which do not have a licence in Norway. Despite the NGA’s own analysis which determined the payment blocking regulation to be ineffective,1 in March of 2017 the NGA suddenly imposed orders on Norwegian banks to block transactions to 7 identified account numbers.2

According to the EGBA, the manner in which the NGA obtained that account number information breaches the privacy protection rules of Norwegian citizens, including citizens that do not have any financial relation with online gambling service providers. The only place the NGA could have obtained the information about these account number is from a database containing data of Norwegian citizens (the Foreign Exchange Register) to which the NGA has no right to access according to Norwegian law. To obtain the account information the NGA would have scanned and obtained login data of payment details belonging to Norwegians citizens that may or may not be not related to online gambling services – and this contravenes Norwegian citizens’ privacy rights as laid down by the European Convention of Human Rights.

Maarten Haijer, Secretary General of EGBA, comments: “Online data protection and the right to privacy are a major concern to all Norwegian and European citizens and rightly so. As more and more of our information goes online, we must be able to trust that our online data is protected. The data protection rules for online gambling companies are very stringent, and these companies are rightly expected and forced to comply with those rules - but the law requires the same from public authorities like the NGA. In this case we believe the NGA has made a clear breach of data protection rules which the Norwegian DPI should investigate and take appropriate action if necessary.”

“The underlying issue is that the current Norwegian online gambling law does not fit with today’s digital reality. Rather than focusing on keeping the Monopoly model in place with increasingly repressive but ineffective enforcement measures, the regulation should focus on the actual needs of Norwegian consumers and provide a safe and competitive offer which enables consumers to play online in a secure and highly regulated environment based on Norwegian law,” Haijer added.

Research Update: UMass Amherst Team Reports Gambling Research Results to Massachusetts Gaming Commission

First Major Cohort Study of Adult Gambling in the United States

AMHERST, Massachusetts (January 10, 2018) -- Results of a baseline study on gambling behavior in Massachusetts that establishes how people participated – or not – in gambling prior to the opening of any casinos were reported today to the Massachusetts Gaming Commission (MGC) by epidemiologist Rachel Volberg and colleagues at the University of Massachusetts Amherst’s School of Public Health and Health Sciences. This is the first major cohort study of adult gambling to be carried out in the United States.

Volberg and colleagues were selected by the MGC in 2013 to conduct a first-of-its-kind, comprehensive, multi-year study on economic and social impacts of introducing casino gambling in the state. The Social and Economic Impacts of Gambling in Massachusetts (SEIGMA) team is examining an array of social and economic effects.

As part of MGC’s robust research agenda, today’s results are from the separate Massachusetts Gambling Impact Cohort (MAGIC) study of factors critical to developing strategic and data-driven problem gambling services. Cohort studies survey the same individuals over time and provide information on how gambling and problem gambling develops, progresses and how individuals may experience remission. “This has significant value as it can highlight risk and protective factors important in developing effective prevention, intervention, treatment, and recovery support services,” Volberg notes.

Today’s report is based on analyses of 3,096 Massachusetts residents who completed the SEIGMA baseline study of self-reported past-year gambling behaviors in Wave 1 in 2013/2014 and Wave 2 in 2015. The researchers observed a statistically significant increase in overall gambling participation as well as in participation in casino gambling and horse race betting within the cohort between Wave 1 and Wave 2. They also report a statistically significant increase in the cohort in the average number of gambling formats engaged in over the previous 12 months. However, in all cases this increase was “quite small,” they note, between 2 and 3.2 percent.

Prior to beginning this research, Volberg predicted that the state’s sweeping research initiative would change the intellectual landscape and knowledge base about gambling, and she says results released today support that view. “This tells us new things, but it is nuanced,” she notes. “Based on this new study, researchers will think about gambling behavior in new ways.”

One interesting finding is “the apparent ease with which people move in and out of problem gambling status within a given year,” the lead author points out. “It’s pretty clear that people phase in and out of the problem gambling group. This movement is different than the way problem gambling has been characterized in the past. Until recently, the general orientation has been that disordered gambling is an unremitting chronic condition.” According to the report, only 49.4 percent of individuals who were Problem or Pathological Gamblers in Wave 1 were in this same category in Wave 2, with sizeable portions transitioning into At-Risk Gambling and Recreational Gambling.

At-Risk Gamblers were the most unstable members of the cohort, with only 37.5 percent being in the same category in both waves. Most of these individuals transitioned to Recreational Gambling, but a significant minority transitioned to become Problem or Pathological Gamblers.

Volberg adds, “We’ve seen this movement in studies done in other jurisdictions, but this will be news to some researchers who are used to thinking of problem gambling as a progressive and chronic disorder.”

MGC Research and Responsible Gaming Director Mark Vander Linden states, “There is great value for the MGC and our public health partners in knowing the movement of people into and out of problem gambling because this data has public health implications for identifying and supporting the spectrum of services that will be most useful in preventing and treating problem gambling.”

An important aspect of all physical and mental disorders is incidence, Volberg says. That is the proportion of a population that newly develops a condition over a specified period of time.

The study reported today found problem gambling incidence in Massachusetts, at 2.4 percent, to be high compared to studies elsewhere. The authors point out, however, that those other studies have different “gambling landscapes,” used different measures of problem gambling and had shorter follow-up periods.

The report notes that the cause of the high incidence rate is unclear given that there was no significant change in the actual availability of legal gambling opportunities in Massachusetts during this time period. Researchers suggest that post-casino cohort survey data will shed additional light on the incidence rate in Massachusetts.

In addition to Volberg and colleagues at UMass Amherst, co-investigator Robert J. Williams of the University of Lethbridge, Alberta, Canada, provided oversight of study design and implementation as well as help with data analysis and reporting. Future analyses will focus on predictors of problem gambling onset and whether there are gender differences in these predictors as well as predictors of problem gambling remission and the extent to which accessing treatment is one of these factors.

Stadium Casino, LLC High Bidder At Second Category 4 Casino Auction

HARRISBURG, PA (January 24, 2018) -- The Pennsylvania Gaming Control Board today held the second in a series of auctions in a process that establishes the order in which the winning bidders select a location for a Category 4 casino.

In today’s public bid opening, in which 4 bids were received, Stadium Casino, LLC, which holds a Category 2 license and will construct a casino in Philadelphia, was the high bidder with a bid of $40,100,005. Stadium Casino, LLC is a joint venture between the Cordish Companies and Greenwood Gaming & Entertainment, LP which currently operates the Parx Casino in Bucks County.

The center of the Category 4 location, which is an area 30 miles in diameter, chosen by Stadium Casino, LLC is located in Derry Township in Westmoreland County.

Stadium Casino, LLC is required to pay the bid price to the Commonwealth within two business days, and then has up to six months to submit an application for the Category 4 Slot Machine License.

The application will contain the precise site of the proposed Category 4 casino, as well as detailed plans and information concerning the proposed building plan, amenities, employment projections and other related information. Once the application is received and determined to be complete, the Board will post public information about the project on its website for interested persons to review.

A Category 4 Slot Machine License would permit the entity to operate between 300 and 750 slot machines. The entity could also petition for permission to initially operate up to 30 table games for an additional fee of $2.5 million with the capability of adding an additional 10 tables games after its first year of operation.

In the first auction held on January 10, 2018, Mountainview Thoroughbred Racing Association, LLC, which operates Hollywood Casino at Penn National Race Course, was the high bidder with a bid of $50,100,000. The center of that Category 4 location is located in the Borough of Yoe in York County.

Both Mountainview Thoroughbred Racing Association and Stadium Casino, LLC are ineligible to bid on additional Category 4 locations during the initial round of auctions. The Gaming Control Board could hold a subsequent round if all 10 available licenses are not auctioned off. If that occurs, successful bidders in the initial round could compete for additional Category 4 casino locations.

The Gaming Control Board plans to hold its next public auction on Wednesday, February 7, 2018 at 10:00 a.m. in its Harrisburg Public Hearing Room in Strawberry Square just prior to its regularly scheduled Board meeting. The auction will also be streamed live from the Board’s web site. Subsequent auctions are planned every two weeks thereafter on Wednesdays at the same time and location.
